Our Law Firm, represented by our lawyers Benedetta Musco Carbonaro and Andrea Soldini, have won a case having provided assistance in a dispute related to the outcome of a decision of the Securities and Financial Ombudsman (ACF).
The ruling accurately reconstructs the instincts of both Securities and Financial, as well as the Banking and Financial Ombudsmen, and highlights that, under its legal nature, it must be qualified as an out-of-court dispute resolution mechanism of a litigious and adjudicative nature, whose decisions, however, cannot become final or constitute an enforceable title, not even by resorting to the instrument of injunction in the event of a decision not executed by the intermediary.
